Sean "Diddy" Combs might remain in New York to serve his prison sentence if the judge has his way.

According to a report TMZ published on Wednesday, October 8, Judge Arun Subramanian recommended that the Bad Boy Records founder serve his 50-month sentence at a prison in New York state. The judge didn't specify which facility Combs should be sent to. Still, he indicated that the prison should have "any available substance abuse program, including the Bureau of Prisons' Residential Drug Abuse Program (RDAP), for which [Combs] qualifies." This comes shortly after the artist's legal team pleaded for him to serve his sentence at FCI Fort Dix in New Jersey.

“In order to address drug abuse issues and to maximize family visitation and rehabilitative efforts, we request that the Court strongly recommend to the Bureau of Prisons that Mr. Combs be placed at FCI Fort Dix for RDAP purposes and any other available educational and occupational programs,” Teny Geragos wrote in a letter sent earlier this week.

Combs was sentenced to four years and two months behind bars for two counts of transportation to engage in prostitution. He was denied bail and spent a year in jail. During his time behind bars, Combs enrolled in various programs designed to help him get over his drug addiction. He addressed his issues with drugs in his final letter to the judge before his sentencing hearing last week.

With time served, Combs will most likely spend three years in prison and has to pay a $500,000 fine. Judge Subramanian had his say about where the 55-year-old artist should go, but ultimately, the Bureau of Prisons has the final say.
